Alibi是一个非常有用的刑事辩护事由。在证据这一概念中,除了人证和物证外,还有一个特殊的、不可忽视的拉丁词,就是alibi, 即“不在犯罪现场的证据”。倘若抓到一个杀人嫌疑犯,而该嫌疑犯能提供alibi,那么破案,定案的难度可能就会大幅增加。

例1:At trial, he raises an alibi defense that he was in another city at the time of the crime.

译:庭审时,他提出了不在犯罪现场的抗辩事由,称犯罪发生时他在另一个城市。

例2:The prosecution attempts to impeach this alibi by showing that when he was questioned by the police while under custody, he failed to assert this alibi, as one would expect he would have done if the alibi had been genuine.

译:检方试图推翻这一不在犯罪现场的抗辩事由,检方称他在被警方羁押期间,并没有提出不在场抗辩。检方认为,如果不在场抗辩属实,他早就应该提出。

例3:Alibi is different from all of the other defenses because it is based upon the premise that the defendant is truly innocent.

译:不在犯罪现场与其他任何抗辩理由均有所不同,因为它建立在被告真正无罪的假设之上。

例4:The defense of alibi denies that the defendant committed the act in question. All of the other defenses grant that the defendant committed the act, but they deny that he or she should be held criminally responsible.

译:不在犯罪现场抗辩理由否定被告人实施了目前发生了的犯罪行为。其他所有类型的抗辩理由都是假定被告人实施了犯罪行为,但是否定被告人(他或她)应负刑事责任。
